The above excerpt of § 101 is the basis of patent law in the U.S. With the exception of a small modification in 1952, § 101 has remained virtually unchanged since written by Thomas Jefferson. Until recent times, the statute gathered little attention. However, with the addition of software and business method patents in the 1980’s, the statute has been the subject of dispute. Until about 1981, the U.S. Patent Office held that steps performed by a computer were unpatentable under at least § 101. However, in Diamond v. Diehr, 450 U.S. 175 (1981), the Supreme Court overruled the Patent Office and held that, though an algorithm and the like are abstract and unpatentable, the fact that an otherwise patentable process is carried out on a computer does not make it unpatentable.

As a result, to this day, software and business method patents are often written in a roundabout manner. For example, Einstein could not patent his famous E=MC2 formula because this is considered an abstract law of nature. However, claim a method of determining the mass of an object based on measurements of light passing through the object, and you have probably at least overcome § 101.

If the difference between the first and second example seem fuzzy, it is because it is. A patent is nothing less than the creation of a property right from an intangible concept, and it is no easy task to define the boundary of an intangible right. King Solomon said, “. . . that which has been done is that which will be done. So there is nothing new under the sun” (Ecclesiastes 1:9). Yet, the Supreme Court famously ruled, “anything new under the sun made by man” is patentable. Diamond v. Chakrabarty, 447 U.S. 303, 309 (1980), quoting S.Rep.No 1979, 82d Cong., 2d Sess., 5 (1952).

For the past 30 years, the Patent Office and the courts have defined and redefined the difference between a patentable process and an abstract concept. No test has ever stood the test of time. A colleague of mine filed a patent we both knew the Patent Office was likely to reject under § 101. He retorted, “Who knows what the law will be in three years when the Patent Office finally examines this application?”

One of the presently used tests was stated by the Court of Appeals for the Federal Circuit in State Street Bank & Trust Co. Here, it was found that an idea is patentable if it produces a useful, concrete and tangible result. State Street Bank & Trust Co. v. Signature Financial Group, 149 F.3d 1368 (Fed. Cir. Jul. 23, 1998). However in 2006 Justices Scalia, Thomas, and Alito noted, “this Court has never made such a statement and, if taken literally, the statement would cover instances where this Court has held the contrary. " Lab Corp. v. Metabolite, 548 U.S. ___ (2006) (referring to O'Reilly v. Morse, 15 How. 62 (1854) for Morse code).

Meanwhile, while the U.S. Patent Office’s Interim Guidelines for Examination of Patent Applications for Patent Subject Matter Eligibility (2005) generally follow the Federal Circuit, the U.S. Patent Office Appeals Board in Bilski distinguished State Street, as only applying to “machine implemented” processes (contradicting State Street itself). The decision, complete with an excerpt from Disney’s Pirates of the Caribbean, is nothing less than a demand that the Federal Circuit’s test be overturned, perhaps, in a bid to decrease that Patent Office’s seven-year backlog for business method patent applications. The Supreme Court may agree.

The Bilski opinion is in the process of being heard en banc at the Federal Circuit, but the issue over whether to draw the line between a man-made discovery versus an abstract concept will likely remain a controversy for a long time to come.

Hoy he tenido la opotrunidad de leer un reportaje en El País, suscrito por Amanda Mars, titulado "La crisis también está en su cabeza" en el que se pone de manifiesto lo que estamos comentado, que la pérdida de confianza del consumidor y la caída económica se alientan mutuamente.

Comenta Amanda que el tinglado funciona así. Las empresas venden productos, los ciudadanos los compran y las empresas ganan dinero, así que realizan inversiones y crean empleo. Entonces la sociedad tiene confianza en lo que ve y en lo que prevé, y sigue comprando productos, con lo que las empresas siguen ganado dinero. A quien no tiene el dinero para comprar, el banco se lo presta. Y todos compran. Y las empresas ganan más. Y crean empleo.

La economía es un juego de círculos viciosos y virtuosos. A la crisis internacional -tangible, virulenta-, se añade la psicosis de la crisis -madrugadora y tozuda-, que pone a los consumidores en huelga y retroalimenta el propio declive.

Desde que comenzó 2008, la tristeza del consumo se agravó, y en el segundo trimestre sólo subió un 1,2%, el peor dato desde la recesión de 1993. Las ventas se hundieron en todos los sectores en el segundo trimestre. Los comerciantes hablan de caídas del 20% de moda, del 40% en mobiliario o del 20% en coches. Y la inversión bajó por primera vez en 12 años, un 0,2%, en buena parte por el cierre de grifo crediticio.

"La crisis es real, la gente no se ha vuelto loca, pero el miedo ha acelerado el ciclo, como en su día la alegría lo hizo al alza. Los españoles han frenado al consumo, no por cómo están hoy, sino por cómo creen que pueden estar en el futuro", explica José García Montalvo, catedrático de Economía Aplicada de la Universidad Pompeu Fabra.

El miedo actúa en el mercado mucho más rápido que la euforia. La economía se está estancando (el último trimestre avanzó un 0,1%), pero la confianza se ha hundido 35,1 puntos en un año, de 86,5 a 51,4 puntos, según el último indicador de agosto.

"Los datos de desempleo de este verano no justificaban caídas tan drásticas, ha habido anticipación, pero así es la economía, un juego de miedo y confianza. El capitalismo es maníaco depresivo", opina Antón Costas, catedrático de Economía Aplicada de la Universidad de Barcelona.

John M. Keynes hablaba de los animal spirits, del espíritu animal de la economía, que ayuda a mover al alza expectativas, consumo, inversión y empleo, como fichas de dominó. El humor influye en las estadísticas.

Y en España, el mal humor estalló con el pinchazo de la burbuja inmobiliaria. Antonio Villarroya, de Merrill Lynch, explica: "Una casa vale tanto, pero si crees que el propietario no puede venderla, lo rebajas, y si lo hacen todos, el mercado se cae".

En el Reino Unido se habla de "avaricia" y "miedo" como los dos grandes mecanismos mentales que mueven el mercado: la avaricia, que hace creer que ese piso que ha ganado valor puede hacerlo mucho más; y el miedo, que provoca lo contrario. Ahora actúa el segundo. En el primer semestre, las ventas de pisos se han hundido un 27,% respecto al mismo periodo del año pasado, según el Instituto Nacional de Estadística (INE), y las promotoras se ven abocadas a rebajas en los precios de hasta el 30%.

Un dato que evidencia el componente psicológico de la crisis, según Costas, son los resultados del indicador de confianza, una encuesta en la que es habitual que, mientras la valoración que los españoles hacen de su economía doméstica mejora, la de la economía en general empeora. "¡Es contradictorio!", exclama.

Con cada dato negativo que se publica, los comerciantes, interlocutores directos de la macroeconomía con la sociedad, se echan a temblar. "Las compras son muy sensibles, son decisiones diarias", siempre repite el secretario general de la Confederación Española de Comercio, Miguel Ángel Fraile.

Sin embargo, "hay mucha hipocresía en todo esto. En la bonanza, la vivienda subía un 16% y las expectativas se inflaban. Y nadie las desinflaba. Nadie decía: eh, esto sube más de lo normal", recalca García Montalvo.

La inflación también ha creado neurosis. Los precios de los productos de consumo más frecuente -como los alimentos, el tabaco o el transporte-, han estado subiendo casi el doble que el total, generando algo parecido a una tasa de inflación psicológica, aunque no real, que también ha contenido el monedero.

La huelga de consumo pone en jaque medidas del Gobierno como la devolución de 400 euros en la declaración de la renta. Para Montalvo, es probable que este dinero se destine al ahorro y no a dinamizar la economía.

"De esto hay que aprender, las familias españolas han incurrido en un desequilibrio mayúsculo, se han sobreendeudado y vivido por encima de lo que podían", apunta Vicente Pallardó, director del Observatorio Internacional de Coyuntura Económica.

La cuestión es hasta cuándo durará. Para Villarroya, la tendencia se invertirá cuando el precio de la vivienda caiga tanto que resulte atractiva para los compradores. Para Pallardó, la clave es la recuperación del mercado inmobiliario estadounidense, una vez encauzado el precio del petróleo.

Para colmo, las últimas advertencias del Banco Central Europeo sobre el empeoramiento de la crisis han hundido las Bolsas metiendo, si cabe aún más miedo.

Por tanto problamente, los consumidores, debiéramos de adoptar una actitud de cierta preocupación ante la crisis pero no de psicosis ni de alarma, porque entonces tardaremos mucho más en salir del pozo.

She didn’t say “no thanks” to the “Bridge to Nowhere” until after Congress had already abandoned it but given Alaska a blank check for $223 million in taxpayers’ money anyway. Far from rejecting federal pork, she hired lobbyists to secure her town a disproportionateshare of earmarks ($1,000 per resident in 2002, 20 times the per capita average in other states). Though McCain claimed “she has had national security as one of her primary responsibilities,” she has never issued a single command as head of the Alaska National Guard. As for her “executive experience” as mayor, she told her hometown paper in Wasilla, Alaska, in 1996, the year of her election: “It’s not rocket science. It’s $6 million and 53 employees.” Her much-advertised crusade against officials abusing their office is now compromised by a bipartisan ethics investigation into charges that she did the same.

Whatever we do and don’t know about Palin’s character at this point, there is no ambiguity in what her ascent tells us about McCain’s character and potential presidency. He wanted to choose the pro-abortion-rights Joe Lieberman as his vice president. If he were still a true maverick, he would have done so. But instead he chose partisanship and politics over country.

As The New York Times reported last Tuesday, Palin was sloppily vetted, at best. McCain operatives and some of their press surrogates responded to this revelation by trying to discredit The Times article. After all, The Washington Post had cited McCain aides (including his campaign manager, Rick Davis) last weekend to assure us that Palin had a “full vetting process.” She had been subjected to “an F.B.I. background check,” we were told, and “the McCain camp had reviewed everything it could find on her.”

The Times had it right. The McCain campaign’s claims of a “full vetting process” for Palin were as much a lie as the biographical details they’ve invented for her. There was no F.B.I. background check. The Times found no evidence that a McCain representative spoke to anyone in the State Legislature or business community. Nor did anyone talk to the fired state public safety commissioner at the center of the Palin ethics investigation. No McCain researcher even bothered to consult the relevant back issues of the Wasilla paper. Apparently when McCain said in June that his vice presidential vetting process was basically “a Google,” he wasn’t joking.

Does anybody else find it disturbing that to qualify for the Paralympics, all you need is a pair of contact lenses? Yes that's right, apparently anyone whose vision is a little blurry can be a Paralympic athlete.

Granted, I have spent a good amount of time on this blog and on others reminding people that the definition of "disabled" can be extremely broad, even reminding my readers that, in fact, one could argue that those who wear glasses could be considered disabled. But isn't the Paralympics supposed to be for athletes who cannot partake in the Olympics with fully functional walking athletes because of their disabilities? That was my understanding.

I was watching the Paralympic Judo and it seemed to me that the athletes who were squaring off in the competition had no visible disability. I thought "Did they add Tourette's Syndrome to the Paralympics?" Because the athletes in the Judo competition definitely had no visible disability, and they had no ailment or disorder holding them back in any way, that is for sure. And this may sound narrow-minded as Hell, but if it is not a visible disability  - if it does not visibly hold one back physically - then it has very little to do with physical competition. So I wanted to know what the guidelines were in the Paralympics.  So I looked it up.
There are certainly many genuinely disabled people in the Paralympics, and the categories make a lot of sense, and they make it fair so as not to have a no-armed, one legged blind man with cerebral palsy fencing against a guy who is near-sighted. But contact lenses? Seriously?

What makes iLeopard such an interesting theme is that it doesn't attempt to rewrite something that works, instead it enhances the best parts. Granted not everyone will like the iTunes 7.0-esque theme, but it works well. Furthermore the theme comes with its own installer; very handy. Installing the theme was quite easy, and there's a simple install option, as well as a more customizable one. I've tried both and liked each. Including a built-in installer means that as a user I don't have to monkey around with system files. I don't know my machine's inner-workings that well, so keeping my distance is a good thing. Granted the theme's creators make a point of saying "whatever happens is on you", which is a must-have. Changing anything has implications.

So far I've encountered no problems and issues. Upon first applying the theme my computer was a little slow to relogin; considering I've changed the look of things though it makes perfect sense. Once installed everything's been running smoothly. iLeopard's strengths are its simplicity, and that it doesn't try to out-do Apple's designers, instead they work with them, adding nice bits of flair. iLeopard is a theme I'd certainly recommend giving a try. One thing to note however: there's no iTunes skin included, but considering the rumors of an iTunes 8.0 release sometime soon, it doesn't make sense to spend lots of time working on a mod only to see the code change. So hopefully we see iTunes included in the mod, but until then it fits in just fine.

The more I hear about Wii Music, the more I want to throw up.

Rock Band = cool: You get to play drums.

Guitar Hero = cool: It has great tunes and the guitar is awesome.

Wii Music = crap: You use the Wii remote to simulate playing Twinkle, Twinkle Little Star on the flute?

Give me a break. Nintendo's bragging about all the instruments you get to simulate. It can only be so fun using a Wii remote to play the cello, guitar, drums, etc. And what's with the song list? Who really wants to play the Legend of Zelda theme over and over?

I watched some Nintendo rep yak on some G4 Tech show (probably EP or X-Play), and he was saying, "The great thing about Wii Music is there's no score, you can't get kicked off the stage and everyone plays together not against each other." And that's fun??

The whole thing reminds me of the kids' sports league's that are trying to eliminate scoring in games because they don't want any children to have to suffer the pains of losing.

Nintendo stop pandering to the nursing homes and give gamers something that isn't absolute rubbish.

Hanna is zipping right along. By 11pm Saturday it had increased it forward speed to 30 mph.  If you want to check out the Tropical Storm Hanna Radar Loop, you better click here fast...it will be gone by Sunday afternoon.

I told you days ago that I liked Ike.  Josephine looks to be even more useless than even I anticipated and Hanna is doing pretty much what I figured, though at one

point early on I thought that it might be mainly a threat to mariners.  In large measure, that was  how it turned out in spite of coming ashore.  In any event, Hurricane Ike has been a nice storm for some time and it appears determined to try to keep it going.  It has many obstacles though.  First, it has the mountains of Cuba.  It seems likely it will strike NE Cuba as a strong Cat 4 hurricane.  Then it moves across Cuba and the mountains which should rip it up pretty good.  But, the National Hurricane Center has ever so slightly shifted their track from running down the center of Cuba to running along the south coast of the Communist Island.  This is not significant in terms of the intensity forecast of the storm except that it is a

shift...previously they had it running through the Florida Strait.  There are several models that want to have the storm emerge in the Northeast Carribean before

running it either west of Cuba or just over the western tip.  Should that occur, and its entirely possible, then the storm would have the potential to not decrease in strength or structure as it would only be over land for a limited duration.  Either way, this guy is going into the Gulf.  A number of models target New Orleans.  However, there are a larger number than previously that suggest it will continue in a more westward motion which might threaten Texas.  In order for it to get all the way to Tejas, it would have to slip under a trof that is scheduled to dig down into the Southern states late in the week.  Even if it does go west, there is the possibility that the storm hooks back around and nails Louisiana from the Southwest.  At least one model suggests that very thing.  There are just so many variables.

Not just with the track but the intensity, which is always a challenge for forecasters. Some of the models want to ramp this guy up to near Cat 5 status again, which would be very unusual for a storm that has been affected structurally.  However, its possible, but not part of the official forecast yet.  The NHC kicks it back to 115 mph after its Cuban interaction.  Nevertheless, when trying to figure out an intensity forecast for this guy one has to consider its visit to Cuba and how long its over land and how much the structure is messed up.  Then, how does it recover. Then there is the upper air environment over the Gulf for the next week. And of course, there is water temperatures, which are plenty warm enough but variations in intensity may occur as it goes over varying areas of  water temperature differentials.  SE Louisiana, one way or another, is a very real possibility. But, its not the only possibility by any stretch so anywhere along the Gulf Coast can conceivably be a potential landfall.  I can create scenarios for just anywhere from Brownsville to Tampa, though I suspect that the window will be a still rather large area from say Galveston to Tallahassee.  There's at least the balance of the week to go and something usually comes up one way or another.  Here's the National Hurricane Center Hurricane Ike 11pm Discussion.

In the Paralympics, a basketball team is made up of five players, each of whom is assigned an individual ranking from 1.0 to 4.5. The combined total of the rankings of the players on the court for one team at any given time cannot exceed a certain number, let's say 15. I saw the opening game of the Paralympics tonight and the commentator made sure to stress that the ranking each player is given does not signify his level of ability, but his level of movement. We are talking about people with all different levels of paralysis here, so I can see what he meant.

But when it comes right down to it, doesn't Kobe Bryant get more playing time with the Los Angeles Lakers because he is able to move in a more effective way than the other players on his team who play his position? And while we are on the subject of the National Basketball Association for Walkies, why is there not such an individual ranking system in the NBA(fW)? Every player in the NBA has a different level of ability, just as is the case in Paralympic Wheelchair Basketball. In the NBA, everyone has proven himself to be capable of competing at at certain level, and if not, he's sent to the CBA or whatever, or he rides the bench all season and is used as warm-up meat for guys like Kobe in practice. The guys who are put on the court are the guys who are able to give the team its best chance at victory.
Now, I'm not trying to be an elitist or to exclude anyone from taking part in the Paralympics, which, for God's sake, was established so that the previously excluded could be included. But making sure that each team has no more than 15 points of ability or whatever it is, on the court at any given time is about a step and a half away from the gym class games of kickball where if one team scores two runs, then in the next inning the other team automatically is allowed to score two runs. Not quite the same thing, but you see where I am coming from, I hope.

     I was brought to this thought because I have been here at this computer going through stuff on digg.com, watching videos from the candidates, reading stories that, while interesting, are about as illuminating as a black hole, and about as informative as dead silence in an empty room.  I was trying to figure out what I would write about today, and it struck me, I just don't care.  I have enough other things going on in my life where, even with the drastic importance of this election, and the awe inspiring events, and I don't mean that in a positive way, that happen every day in a million places, things just aren't registering.  The dull ache in my head just behind my eyes.  The resigned shrug every time I read ANOTHER story about some asshole being an asshole to another asshole.  The thought that I may just read one more story by a person who is OUTRAGED by some thing or another.  Ya know what matters to me?

    My Wife.  Bills.  Sleep.  The noisy new landlord.  Bugs in my apartment.  Rain, too much rain.  And so in honor of this almost complete , albeit temporary, ambivalence towards the world, I have decided to dedicate this blog to the Number 340.  That is how many times I have posted a blog here on wordpress.com.  What does it mean?  Not a damn thing.  And I am pleased at that.  Ya know tho.  I will post some political stuff for all that I've just said.  Just a few links.  Peruse and enjoy.

Tambien vemos como en tan solo 4 años han surgido nuevas fuentes de noticias para los maqueros a traves de los blog. Uno de ellos es MacNN.com, quien junto a TUAW, MacRumors, 9to5mac e iLounge llevan la delantera y la competencia sobre quien publica la noticia mas caliente.

Hace solo 6 años, pese al incremento y la facilidad de acceder al internet, obtener informacion sobre las novedades maqueras no era tan facil como ahora. Muchos maqueros dependiamos de las secciones de tecnologia de las web de noticias o de las versiones en linea de las revistas como MacWorld, que no tenian el mismo rango de actualizaciones que ahora encontramos.

Ultimamente, cada vez que se acerca una nueva keynote, se inician los rumores sobre lo que se presentara. Que si un nuevo iPod, que si un iPhone Nano, que si una Mac Mini renovada, que si una TabletMac, que si cuantas cosas traten esos rumores.

Pongamos el caso del lanzamiento del iPhone 3G. Antes de Apple presentar el nuevo telefono se iniciaron los rumores de su posible lanzamiento casi dos meses antes del mismo. Se dijeron muchas cosas, entre ellas que Apple finalmente resolveria el problema de no poder sincronizar archivos via bluetooth, que mejorarian el sonido del altavoz, que tendria un nuevo diseño de carcasa entre otras cosas mas. Algunos de los rumores terminaron siendo cierto y otros no.

Aproximadamente un mes antes empezaron aparecer fotos de fundas para el nuevo modelo del iPhone, que daban por cumplidas las sospechas que el modelo cambiaria su diseño. Como vimos, los rumores en ese sentido tambien fueron correctos.

Para poder diseñar fundas para el iPhone nuevo, los fabricantes debieron primero hablar con Apple para que este les entregara las medidas y especificaciones. Varias de las fundas salieron a la venta semanas antes del lanzamiento del iPhone, dando por sentados los rumores del rediseño.

Para este nuevo keynote del proximo martes 9 de septiembre, Apple envio las invitaciones. En ella se ven algunas evidencias que el tema a tratar seran los nuevos iPods que se rumoran, a partir de las graficas usadas tal si fueran una pantalla de iPod Nano o Classic, ademas del supuesto relanzamiento de iTunes 8.

Antes que eso hemos avistado por ahi fotos de un supuesto iPod Nano (foto adjunta), rediseñado por segunda ocasion y con la supuesta inclusion de pantalla touchscreen. Junto a esas fotos del nuevo iPod se han visto tambien fundas especiales, causantes ambas evidencias de muchos comentarios.

Todos conocemos el hermetismo de Apple para los nuevos productos en proceso de desarrollo o de lanzamiento. No es la primera vez que en la compañia de Cupertino se niegue que esten trabajando en algun producto y luego de un tiempo veamos el producto en la siguiente keynote, como paso con el iPhone de primera generacion, que negaron en muchas ocasiones hasta que tio Steve sorprendio al mundo.

Apple quiere mostrar hermetismo, pero flaquea al dar informacion privilegiada por adelantado a empresas fabricantes de perifericos y añadidos, informacion que supuestamente quieren proteger del resto del planeta.

No sera que Apple entiende perfectamente la importancia que tienen los blogs maqueros y la incidencia de los mismos en los mercados al que quiere llegar, para cuando lancen sus productos, estos se vendan como pan caliente ???. De tal manera, no sera acaso que ese supuesto "hermetismo" es parte de la estrategia de ventas ???.

Creo que la respuesta es obvia. Vemos como la gente se interesa "desesperadamente" por cualquiera de sus gadgets, vemos el exito del iPhone, vemos el conocidisimo exito del iPod, vemos el exito que ha tenido el MacBook Air (cosa que no entiendo ni apoyo).

Mantener el hermetismo aumenta mas el interes del mercado. Mientras mas interesado se encuentre el mercado, el exito sera mayor, porque el mismo mercado se encargara de hacer la mejor publicidad que puede recibir una empresa (y de gratis), la de los comentarios.

Tengo mis dudas sobre Apple, pero Steve Jobs ha demostrado en estos mas de 10 años de gerenciar esa empresa, que sabe lo que hace. Sabe mantener el mercado, sabe lo que el mercado quiere y si no lo quiere, sabe como hacerlo interesarse.

Los blogs maqueros son los medios mas importantes para llegar al publico, de hecho un publico bastante extenso compuesto por maqueros y no maqueros. Apple continuara negando las informaciones mientras las fuentes de noticias y blogs continuen indagando y corroborando aquello que Apple niega. De todos modos a Apple que le importa, si esa es la clave de su exito !!!.
