<span class="postbody1">b)Staten kan som betingelse for å trekke seg tilbake fra slike områder kreve at det blir opprettet sikkerhetstiltak som med rimelighet kan ventes å sikre at området ikke igjen blir brukt til å iverksette trusler, eller bruk av makt mot det som er av en slik art at det berettiger bruk av selvforsvar </span><br />
<span class="postbody1">c)Når den tidligere innehaver av området hadde sikret seg dette på en ulovlig måte, har den staten som senere tar dette området under lovlig uttøvelse av selvforsvar, en sterkere rett enn den tidligere innehaver". </span></span></p>
<p><span class="postbody1">Ut ifra det Stephan Schwebel kan man trekke en rekke konklusjoner. Bl.a. at </span><br />
<span class="postbody1">*okkupasjonen er lovlig fordi de områdene Israel tok i 1967 ble tatt i en forsvarskrig </span><br />

<content:encoded><![CDATA[<p>Mange er de om dagen som advarer det usamerikanske folk, og verden forøvrig, om de høyst alarmerende fremtidsutsiktene <em>vi</em> står overfor med BushCos voldtekt av den amerikanske grunnloven, forakt for internasjonal lov, tortur, spionering, fengsling uten lov og dom, preventiv internering - <em>und zu weiter...</em> </p>
<p>Jeg sier <em>vi</em> fordi det som foregår i verdens eneste supermakt, eller imperium om du vil, angår <em>alle</em> Jordas innbyggere. </p>
<p>Norges deltakelse i den løgnbaserte <a href="http://www.mediamonitors.net/francis21.html">Krigen</a> mot Terror, og vårt "buddy-buddy"-forhold til USA gjør at det absolutt angår oss. Dessverre. </p>
<p>For alle som har fulgt med på den politiske utviklingen i USA (og i verden) siden 9/11, er det klart som dagen at <a href="http://www.truthnews.us/?p=1115%5D">hårreisende lovgivninger og tiltak</a> har lite å gjøre med krigen mot terrorisme.</p>
<p>Det handler <em>ikke</em> om krig mot den terrorismen vi har blitt så vant til å definere <em>terrorisme.</em> Den terrorismen synes å være ønsket.</p>

<p>In order to better prosecute his bogus "war on international terrorism," under the pernicious influence of Federalist Society Lawyers President Bush Jr. personally resurrected a long-defunct World War II era legal category of dubious provenance denominated " unlawful enemy combatant," which was soon thereafter superseded by the Four Geneva Conventions of 1949.</p>
<p>Bush Jr. has used this quasi-category to create an anti-matter universe of legal nihilism where human beings (including U.S. citizens) can be disappeared, detained incommunicado, denied access to attorneys and regular courts, tried by kangaroo courts, executed, tortured, assassinated and subjected to numerous other manifestations of State Terrorism.  This Bush Jr. category of "unlawful enemy combatants" negates almost the entirety of the post-World War II regime for the International Protection of Human Rights established by the U.N. Charter in 1945 and most of the major international human rights treaties derived therefrom, which are too numerous to list here.</p>
<p>Bush Jr.'s gross mistreatment of "unlawful enemy combatants" also violates several basic protections of the United States Constitution and in particular the Bill of Rights, again too numerous to list here.</p>
<p>At a minimum, those responsible Bush Jr. administration officials, including the President himself, run the risk of international and U.S. domestic criminal prosecution for violating the Third and Fourth Geneva Conventions of 1949.  No wonder that the Bush Jr. administration has done everything humanly possible to sabotage the International Criminal Court.</p>
