Point 1: Enforceability

If you take a book or CD off a neighbor's shelf, is it stealing? Yes. Of course it is. The fundamental problem with this is that your neighbor no longer has the book or the CD in question. Is it considered stealing if you read that book, or listen to the CD? Have you somehow reduced the value of either object? No. Those who would put DRM (Digital Rights Management) software on all IPF (Intellectual Property [containing] Files) seem to believe otherwise. In many cases, IPFs cannot be freely transfered between computers or devices due to DRM software.

But let's not mince words. The problem isn't that iTunes will only let us listen to our music on five computers and makes it difficult, if not impossible, to transfer music from one computer to another, particularly music not acquired through iTunes. The problem is that we're expected to pay for music, music files with prohibitive DRM, when we could get the same file DRM free elsewhere. The only hitch is that this action is illegal under current law in the U.S., at least for certain methods of acquiring the file. Limewire, Frostwire, and BitTorrent are all filesharing programs which cannot be legally used to share copyrighted files such as most music, books, or movies in digital format. Other methods of acquiring files, namely MP3 search engines such as Skreemr are in a legal gray area.

So why, other than the presence of the law, should I not download MP3s and other files for free? Am I going to get caught? Probably not. Even if the feds somehow discover that I've downloaded a file via Limewire or BitTorrent, it's nearly impossible to trace that file to discover whether or not the source was legal, or where I got it from. Especially with BitTorrent. It's not as if the government can track every transaction made over the internet so that in some police office near you a little light goes off for your address whenever an illegal file is transfered to or from your computer.

Let's assume for a moment that websites such as SkreemR are made illegal and removed from the internet in a sudden, decisive government action. Further assume that all file sharing programs are made illegal (they are currently legal, but the sharing of IPF is an illegal use), and are magically erases from all computers. I can still find files, with a little more difficulty, on the internet. Some obsessed secretary typed up the entirety of Harry Potter and the Sorcerer's Stone into a .txt file and posted it on his personal website? Cool, I'll download it and put it on my Kindle. Not convinced? Alright, assume that someone developes an amazing web crawler which finds and deletes any illigal IPF posted on the web. What's to stop my friends and I from e-mailing eachother all the songs off of any CD's that we buy? Absolutely nothing (say it again).

Now, this is specific to music and multimedia, but note that there is no DRM on most CDs

and DVDs sold in stores today. Thus there is no need for DRM to be cracked before distributing a file. All that needs to happen is for one person with little to no technical know now to buy a CD or DVD and upload contained the IPF to the internet. All of a sudden there's no need for anyone else to buy a copy- it's freely available to anyone in the world.

The totality of that availability- the fact that anyone in the world can download it- offers another complication. The laws and regulations of multiple international juristictions. Hypothetical situation. User 1 lives in Bangladesh, where IP law protects music for ten years. Ten years after the song "Hittin' up the Hits" was registered and released in Bangladesh, User 1 uploads the file to her blog. User 2 lives in Brazil, where IP law protects music indefinitely. User 2 sees the song on the blog and downloads it. Legally, things get really complicated, really fast.

The last defense for the downloader of illigal IPF is this- strength in numbers. There are far too many people dowloading them to catch them all. IP law in the Information Age is like Prohibition. It may or may not be a good idea from an idealogical standpoint, but it's not going to walk. The government should just eliminate or alter the law and stop embarrassing itself by pretending that the current law has any meaning.

Diese oft vernommene Ansage ist natürlich Mumpitz. Man könnte entgegnen, dass man sich sicher mehr Deodorant oder Schuhe kaufen würde, wenn selbige billiger wären. Wir alle könnten ein Mehr von jeder beliebigen Ware ergattern, hätte sie nicht den realistischen Preis, welcher aus den kalkulierten Kosten von Produktion und Verkauf einerseits und der Gewinnspanne andererseits resultiert. In diese Berechnung fließt auch die Marktsituation ein, sprich die Bereitschaft des Durchschnittskunden für die Ware einen gewissen Preis zu zahlen. Eben dieser muss jedoch eine dauerhafte Kostendeckung und natürlich auch einen Ertrag ergeben. Im konkreten Fall der Musikbranche sind die derzeit marktüblichen Preise wohl notwendig, um das kreative Potential mittelfristig zu erhalten.

"Den riesigen Plattenfirmen will ich kein Geld in den Rachen schieben. Und eine Madonna oder eine Britney Spears verdient immer noch genug, auch wenn ich mir ihre Alben übers Filesharing besorge."

Das System mit all seinen Schattenseiten funktioniert derzeit so, dass jedes Label bzw. jeder Entertainment-Konzern einige wenige Artists pusht. Da wird viel Kohle in die Werbung gebuttert, damit die Zugpferde der Musikindustrie den Firmen große Gewinne bescheren. Dass dieses Geld zu einem (oft marginalen) Teil in weniger kommerzielle Musiker und deren Projekte investiert wird und selbigen somit erst Plattenveröffentlichungen ermöglicht, wird in oben angeführten Milchmädchenrechnung gerne unterschlagen. Dies machen die Labels freilich nicht aus einer philantropischen Weltsicht heraus, vielmehr müssen auch sie auf einen Mix von Stilen und Interpreten setzen, um am Markt mit all seinen Nischen präsent zu sein.

Zweifelsohne zahlen auch viele Menschen ihr U-Bahn-Ticket. Sicherlich entrichtet auch die große Mehrheit an Staatsbürgern die Steuern. Das entbindet den Einzeln jedoch nicht seiner Verpflichtung. Im Gegenteil, allein aus Solidarität mit den Zahlern, welche ja durch ihren Beitrag die Nicht-Zahler mitsubventionieren, besteht für jedermann die Pflicht dies auch zu tun. Alles andere ist und bleibt Diebstahl, beziehungsweise in den angeführten Beispielen Betrug.

"Künstler sollen sich nicht an die Musikindustrie ausliefern und ihre Alben gefälligst selbst herausbringen. Dann würde ich sie auch durch meine Käufe unterstützen."

So berechtigt die Forderungen nach tiefgreifenden Änderungen im System auch sind, so wenig wird dabei bedacht wie schwierig sich die Revolte für den einzelnen Musiker präsentiert. Neben der musikalischen Kompetenz verlangt solch Handeln auch in hohem Maße wirtschaftliches und vermarktungstechnisches Know-how. Und würde ein Großteil der Konsumenten wirklich auf die Abkehr von althergebrachten Absatzschienen eingehen? Otto Normalverbraucher erwirbt sein Bio-Gemüse auch im Supermarkt anstatt es direkt am Bauernhof zu kaufen. Sobald wir also einen großen Vertrieb in Anspruch nehmen und unsere CDs bei Amazon kaufen, schlägt die Handelskette natürlich gleich etwas drauf. Verständlich, sie ist ja keine Non-Profit-Organisation. Es liegt also im fehlenden Wagemut oder auch in unser aller Faulheit begründet, warum alternative, direkt durch kleine Label oder den Künstler selbst gestaltete Vertriebskanäle noch nicht funktionieren. Dies können sich bislang höchstens etablierte Superstars wie Radiohead erlauben.

Damit kommen wir zum Thema des geistigen Eigentums. In dem ich selbiges höre/lese/sehe, nutze ich es somit auch. Und folglich ist dafür eine Abgabe fällig. Sei es der Eintrittspreis im Kino oder eben der Preis eines Albums. Manchmal scheint diese Nutzungsgebühr zu entfallen, weil andere dafür aufkommen, Im Falles der privaten Radios wird die Gebühr vom Sender an die GEMA entrichtet und durch Werbung finanziert. Filesharing jedoch basiert auf dem Prinzip, dass eine gekaufte CD oder auch MP3 vielfach kopiert (damit auch genutzt) wird, hingegen lediglich einmal bezahlt wird. Der Sinn dieser Nutzungsgebühr liegt in der Finanzierung der Kreativen. Und dies sollte uns ein Anliegen sein, wird doch unser aller Leben durch die vielfaltige Ausformung von Kreativität bereichert.

Stimmt! Die Art und Weise, wie sich Firmen und Künstler gegen den Diebstahl wehren, ist fragwürdig. Legalisierte Stasi-Methoden führen zu einem Generalverdacht gegen jeden Internet-Nutzer. Dass Copyright-Inhaber freilich ein Recht darauf haben, gegen den Diebstahl des Eigentums vorzugehen, dies ist eine rechtsstaatliche Selbstverständlichkeit. Wie das vernünftig und praktikabel umzusetzen ist, darauf wurde bis dato noch keine Antwort gefunden.

Ziehen wir ein kurze Schlussfolgerung. Die derzeit übliche Kultur des Stehlens gründet auf Ignoranz und Unrechtsbewusstsein. Man sollte sich daher nicht fragen, wie man an ein Lied kommt, ohne dafür auch nur einen Cent zu zahlen, sondern stattdessen ein forsches "Wo bitte geht es zur Kasse?" an den Tag legen. Denn eigentlich gilt ja sogar im kapitalistischen Zeitalter der flapsige Spruch "Wer zahlt, schafft an!". Denn die Fülle der Konsumenten hätte zweifelsohne die Möglichkeit das System zu ändern, wenn sie es nur wirklich wollten.

UPDATE: An item just brought to our attention by kibbels at n4g regarding GamePolitics comments on file sharing but originally reported by Edge Online as distribution offences.

We all know the perils of File-Sharing and the consequences it can have. But very few take the risk seriously. Well 3 games are doing that right now as Activision take them to court for sharing COD 3 files across the net.

Mums/dads, say NO to your kids when they ask if they can "just download a game off the net . . . . PLEASE", it could cost you tens or even hundreds of thousands of dollars for the privilege of owning a FREE game . . .

Two of the games have already agreed to pay sums in the amount of$US125,000 in total. Being, $US100,000 for Shawn Guse and $US25,000 from Chris Hyman, for their roles in copying and distributing copies of COD3 and Tony Hawks Project 8 on both the Wii and Xbox 360.

Recently Game Politics showed a list of several gamers who have been caught out with regards to game piracy, and the list is not a nice one to see. It shows that your everday mum as well as business people are in on the act of file-sharing to a large degree.

We are not talking about one or two copies of games, but hundred, and in some cases thousands of copies.

While I agree with Peter Moore with regards to not alienating your market in his comments when Atari, Codemasters and 3 other major developers took several gamers to court recently, ("However, Ex MS Xbox-DIv big boy Peter Moore and now EA Sports CEO has other thoughts on the matter, stating that this is not the way to get around the issue. He commented that “I’m not a huge fan of trying to punish your consumer,” further commenting . . . “Albeit these people have clearly stolen intellectual property, I think there are better ways of resolving this within our power as developers and publishers.”" ) - one does need to also set an example, and bring people into line with regards to large distribution schemes theyhave going. Game developers, and those that work for them are just like you and I.

They work for their daily income, they build items that they should get reward for, and if you or I take those goods and resell or distribute them illegally, then we are stealing and taking their rightful payments away from them.

They have families to feed, bills to pay, just like the rest of us. So where does one draw the line . . ?

I just downloaded the new LimeWire software. It's pretty cool actually. It's a peer to peer file sharing application that really picks up where Napster left off and it does not hammer you with ads.

This file sharing network quickly replaced the famous old Napster after it has been shut down and is now more popular than ever..

The new cleaned up Java interface in version 4.1  of Limewire looks way better than earlier versions. You know it's made for the business of exchanging files and nothing distracts from that goal.

Because it is written in Java it can be used on any Operating System where java can be installed. That includes Windows, Mac OS, Linux, Unix and Solaris.

This has also disadvantages. It needs Java to run. That means you should take care that you always have the latest version of Java installed on your computer and it's quite "resource heavy".

Another reason for it's success might be, that it doesn't tackle you with ad-ware, nag-ware or hurting colors. It just convinces with a clear and transparent surface for searching, downloading, browsing and collecting files.

Danish ISPs have rejected proposals from the IFPI for a “3-strikes and you’re out” policy to deal with illicit file-sharers. In a joint statement, the telecoms companies said that they would not be a part of “detection and monitoring” activities and that the solution to piracy should come from elsewhere.

Efforts to reach a voluntary agreement between the IFPI and ISPs in Denmark on the issue of unauthorized file-sharing have failed. The telecoms companies have completely rejected the demands of the music industry.

The IFPI wanted to be able to hunt down file-sharers, report them to their ISP and have them implement a so-called “3 strikes” policy. They proposed that the first time someone got caught sharing copyrighted files, they would receive a warning from the ISP, the second time they would have their Internet connection slowed down. After a third warning, or strike, the user would be disconnected from his ISP and banished from the Internet.

ISPs in the UK recently reached an agreement with the IFPI to send out warnings to alleged file-sharers, but rejected any further sanctions against their customers such as speed capping or disconnection. However, according to a Comon report, the Danish ISPs have rejected the proposals completely. They say they will not take part in “detection and monitoring activities” and believe that the proposals would constitute a contravention of the law, and would upset the balance between the interests of the individual and economic interests.

Fate girare la voce a tutti i vostri amici italiani di usare http://labaia.org per accedere al nostro sito finchè questa questione non sarà risolta."

Ma puntualmente dopo poche ore anche labaia.org era irraggiungibile.

Ma andiamo con ordine. Per chi non lo sapesse, "Piratebay" è il più grande sito al mondo di indicizzazione di file .torrent. Attualmente ci sono quasi un milione e mezzo di torrent nel database...non so se mi spiego.

Forse chi usa ancora solo ed esclusivamente  Emule, e non è avvezzo al mondo di Bittorrent non ne ha compreso granchè, ma diciamo, per intenderci, che è un po' come se decidessero di chiudere non solo i server di Emule (come Razorback, edonkey server et similia - ed è già accaduto-) ma anche la rete Kademlia, non permettendo più a nessun peer di collegarsi ad un altro peer...ho reso l'idea?

Difatti la funzione del file .torrent è proprio questa: dare la possibilità, a chi vuole scaricare un file, di sapere chi possiede in quel momento qualche pezzo di quel determinato file, e potervisi connettere, formando il cosiddetto "swarm" (in italiano, "sciame") di peers che ruotano uno intorno all'altro scambiandosi "chunks", ovvero "pezzi" di quel file che si vuole ottenere. Chi usa Azureus sa di cosa sto parlando, essendo un programma che offre la reale possibilità di vedere in diretta lo swarm-funzione tra l'altro molto affascinante da osservare.

E' chiaro che i file veri e propri con contenuti multimediali (per esempio un film, o un mp3) non risiedono nel file .torrent nè tantomeno sui server di Piratebay, (che se non ricordo male sono server locati in territorio svedese) la quale si limita a fornire il .torrent, che contiene esclusivamente, come già detto, le informazioni per connettersi vicendevolmente, nonchè le informazioni tecniche sul file in questione.

Ma allora qual'è la cosa che lascia di stucco e perplessi di questa vicenda?

E' che improvvisamente, di punto in bianco, l'Italia blocca tutti gli accessi a questo sito, nè più nè meno che una censura bella e buona.. Io  personalmente odio ogni forma di censura, perciò la cosa mi ha subito irritato, e gran parte del popolo della rete ne è rimasto inorridito.

Intendiamoci: i metodi per accedere al sito esistono lo stesso, con Opendns il sito si riusciva a raggiungere lo stesso, e questo era solo uno dei modi.

Comunque sia, per concludere, la cosa che secondo me è intollerabile è il fatto della censura a monte, di quella censura della quale tu sei tenuto all'oscuro.

E' come se in libreria io non potessi vedere certi libri sugli scaffali perchè QUALCUNO ha deciso che non possono essere messi in vendita a causa dei loro contenuti, e PERCIO' io non devo sapere neanche che esistono, RAGIONE PER LA QUALE anzichè posizionarli sugli scaffali, li hanno nascosti in una teca riposta nello scantinato della libreria.

Non sto negando che tramite il sito di Piratebay si potesse avere facile accesso ad un'enorme quantità di films e cd musicali attualmente coperti dal diritto d'autore. Questo è vero, inutile far finta che le cose non stiano in questi termini. Ma se io accedo al sito non significa che automaticamente vengo in collisione con questi contenuti e allora devo scaricarli per forza, divenendo così in un batter d'occhio un pirata.

Navigando nel sito si scoprono molte informazioni anche su pellicole di cui certamente si ignorava la circolazione, difatti vi sono tantissimi link che rimandano all' IMDB (Internet movie database), con tanto di recensioni e commenti al seguito.

Comunque sia, ora il sito è di nuovo accessibile. Ebbene sì, da quanto ho letto due avvocati italiani, a titolo gratuito, sono riusciti a controbattere le imputazioni mosse a carico dei gestori della baia, e il giudice ha dovuto riconoscere le ragioni che hanno addotto.

Ma chissà, forse la vicenda non è ancora finita, e possiamo aspettarci altri risvolti nel prossimo futuro. Nel frattempo, siamo liberi di navigare.

Lassen wir einmal die Anfangsjahre des Filesharings (Napster) ausser Acht. Seit einiger Zeit ist die Rechtslage eindeutig. Filesharing auf Tauschbasis (Upload und Download) ist illegal, weil es Copyrights verletzt. Da dieses Thema in den Medien sehr präsent war und ist, handeln Filesharer mehrheitlich wissentlich gesetzeswidrig. Warum tun sie das? Die Argumentation, dass ein Album zuerst eines ausführlichen Probehörens unterzogen werden muss, ehe man dann einen Kauf ins Auge fasst oder aber davon Abstand nimmt, ist angesichts der unzähligen kostenlosen Möglichkeiten ausführlichen Streamens nicht haltbar. MySpace, Last.fm oder iLike sind die bekanntesten Quellen, doch auch auf Künstler-Homepages findet man diese Option vermehrt. Die angeführten Gründe, wonach die Plattenfirmen und viele Künstler ohnehin schon zu reich sind, scheinen ebenfalls obskur. Die Telekom ist auch "reich" und dennoch muss man die monatliche Telefonrechnung begleichen. Der Künstler erschafft Kunst aus einem inneren Bedürfnis heraus und unter Verwirklichung seiner Talente. Die gesellschaftliche Sehnsucht nach Kunst ist durch die Jahrtausende ungebrochen. Wir suchen Inspiration durch die vielfältigen Formen des Kunstgenusses. Insofern ist der Wunsch des Künstler seinen Lebensunterhalt mit der Produktion von Kunstwerken zu bestreiten legitim. Er bietet uns Erbauung, Unterhaltung und Anregung, liefert eine Dienstleistung. Das Aufkommen der Demokratie hat auch den Künstler endgültig vom Mäzenatentum befreit und eine breite gesellschaftliche Unterstützung in Form von Käufen einerseits und einer staatlichen Förderung ohne Einflussnahme andererseits erlaubt. Filesharing stellt eine existenzielle Bedrohung für Musiker dar, der Verdienstentgang trifft arme und reiche Musiker in gleichem Maß. Die sich gleichzeitig ständig verstärkende Kommerzialisierung von Kunst im Allgemeinen und speziell Musik verstärkt den Druck. Die von Konsumenten genützten Kanäle des Erwerbs bleiben kleineren Labels und Musikern, welche sich nicht dem Diktat der Industrie beugen, oft verschlossen. Nicht jedes Album ist eben über Amazon erhältlich.

Doch zurück zur Anatomie eines Tunichtguts. Der Filesharer befriedigt seinen Wunsch nach Inspiration und Unterhaltung, in dem er Musik konsumiert, spricht aber gleichzeitig dem Musikschaffenden das Recht ab, dafür auch ein Entgelt zu bekommen. Wie aufrichtig ist solch eine Handlung? Wie sehr ist das nicht Ausdruck einer derzeit vorherrschenden Mentalität, die sich in der Gier erschöpft? Alles soll/muss jederzeit gratis verfügbar sein. Ein "Will haben!" ohne gleichzeitige Gegenleistung erscheint zutiefst egoistisch. Sagen wir den Egoisten den Kampf an!

The European Parliament has voted in favor of an amendment that will prevent member states from implementing three-stikes laws. Disconnecting alleged file-sharers based on evidence from anti-piracy lobby groups restricts the rights and freedoms of Internet users, according to the amendment.

The amendment, drafted by Guy Bono and other members of the European Parliament, was adopted by an overwhelming majority. 573 parliament members voted in favor while only 74 rejected. Satisfied with this outcome, Bono stated in a response to the vote: “You do not play with individual freedoms like that,” and said that the French government should review its three-strikes law.”

The vote was welcomed in other member states as well. Swedish EU parliamentarian Christofer Fjellner said in a comment: “What’s important about this decision is that now it’s clear that you can’t force [internet service] providers to ban people from the Internet without a legal process.”

The debate surrounding filesharing and how to stop it always boils down to one thing: the ISPs that provide us with our broadband connections always claim, as a general rule, that they're unable to somehow filter illegal filesharing while allowing other net activity to proceed normally.
